Terms of Service

These Terms of Service ("Terms") govern your use of Storybook Generator ("the Service"), operated by Crunchy #s, LLC, doing business as Crunchy Tools ("we," "us," or "our"). By accessing or using the Service at storybook.crunchy.tools, you agree to these Terms.

1. Service Description

Storybook Generator is an AI-powered tool that transforms stories into beautifully illustrated children's picture books. Users can input text, upload documents (PDF, EPUB, TXT), or search for classic stories, and our AI generates age-appropriate illustrations and formatted storybooks.

The Service is designed for parents, guardians, educators, and adults who wish to create illustrated storybooks for children. It is not directed at children under 13.

2. Accounts

To use the Service, you must sign in with a Google account. By signing in, you:

• Confirm that you are at least 18 years old or have parental consent
• Agree to provide accurate account information
• Are responsible for maintaining the security of your account
• Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Credits and Payments

Credit System

Storybook generation requires credits. Each credit allows you to generate one complete storybook.

• Free tier: New users receive 1 free credit upon creating an account
• Standard pack: 10 credits for $14.99
• Pro pack: 30 credits for $34.99

Payment Processing

All payments are processed securely through Lemon Squeezy (powered by Stripe). We do not store your credit card information. By making a purchase, you also agree to Lemon Squeezy's terms of service.

Refund Policy

• Unused credits: If you have not used any credits from a purchased pack, you may request a full refund within 30 days of purchase by contacting contact@crunchy.tools.
• Partially used credits: If you have used some credits from a pack, the used credits are non-refundable. We may issue a prorated refund for unused credits at our discretion.
• Fully used credits: Credits that have been used to generate storybooks are non-refundable.
• Free credits: The free credit provided at signup has no monetary value and is not refundable.

4. Content Ownership

Your Content

You retain ownership of the content you provide to the Service (story text, uploaded documents, character photos). You also own the generated storybooks created from your inputs.

Our License

By using the Service, you grant us a limited, non-exclusive license to process your input content through our AI pipeline for the purpose of generating your storybooks. We do not claim ownership of your generated content.

We may use anonymized, aggregated usage data to improve the Service, but we will not use your individual storybooks for marketing or share them publicly without your consent.

AI-Generated Content

Illustrations are generated by Google Gemini AI. While you own the resulting storybooks, the AI-generated images are subject to Google's terms regarding AI-generated content. We make no guarantees about the exclusivity of AI-generated imagery.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is harmful, abusive, threatening, or harassing
• Create content that exploits or endangers children
• Generate content that promotes violence, hatred, or discrimination
• Infringe on intellectual property rights of others
• Attempt to reverse-engineer, hack, or disrupt the Service
• Use automated systems to access the Service without permission
• Resell or redistribute the Service itself

We reserve the right to remove content and suspend accounts that violate these guidelines.

6. Shared Storybooks

The Service allows you to generate public share links for your completed storybooks. When you share a storybook:

• Anyone with the link can view the storybook (read-only)
• You are responsible for the content you choose to share publicly
• You may revoke share links at any time

7. Service Availability

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control, including third-party API outages.

8. Limitation of Liability

To the maximum extent permitted by law, Crunchy #s, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Indemnification

You agree to indemnify and hold harmless Crunchy #s, LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
